1. Service Description

MiniShoots is a mobile application and web service that helps photographers manage mini-session bookings, collect payments, and automate client communications. The service includes:

• Event creation and booking management
• Payment processing through Square
• Automated email and SMS notifications
• Client directory and booking history
• Subscription management (Starter, Pro Monthly, Pro Annual plans)

2. User Accounts

2.1 Photographer Accounts

You must create an account to use MiniShoots. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activity under your account

2.2 Client Bookings

Clients who book sessions through MiniShoots agree to provide accurate contact information and make timely payments according to the photographer's policies.

3. Subscription Plans & Fees

3.1 Plan Types

Starter Plan: Free to use with a 4.9% commission on each booking and a $25 minimum booking price requirement.

Pro Monthly: $99/month subscription with 0% commission and no minimum booking price.

Pro Annual: $399/year subscription with 0% commission and no minimum booking price.

3.2 Payment Processing

All payments are processed through Square. By using MiniShoots, you agree to Square's terms of service. MiniShoots commissions (for Starter plan users) are automatically deducted from each payment.

3.3 Subscription Billing

Pro subscriptions are billed in advance through Apple In-App Purchase. Subscriptions automatically renew unless canceled at least 24 hours before the renewal date.

4. Payment Terms

4.1 Booking Payments

• Photographers set their own pricing and deposit requirements
• Clients pay directly through Square Payment Links
• Payments are transferred to the photographer's Square account according to Square's payout schedule
• MiniShoots commissions (Starter plan) are deducted at time of payment

4.2 Refunds

Photographers are responsible for issuing refunds according to their own cancellation policies. MiniShoots provides tools to process refunds, but refund decisions are at the photographer's discretion. See our Refund Policy for details.

5. Cancellations & No-Shows

5.1 Client Cancellations

Clients can cancel or reschedule bookings according to the photographer's cancellation policy (typically 48 hours in advance). Photographers may charge cancellation fees or retain deposits for late cancellations.

5.2 No-Show Policy

Photographers may mark bookings as "no-show" and charge penalties when clients fail to attend scheduled sessions.

6. Prohibited Uses

You agree not to:

• Use MiniShoots for any illegal purpose
• Violate any laws or regulations
• Impersonate others or provide false information
• Interfere with or disrupt the service
• Attempt to bypass payment processing or fees
• Use the service to send spam or unsolicited messages
• Reverse engineer or attempt to extract source code

7. Data & Privacy

We collect and use personal information as described in our Privacy Policy. By using MiniShoots, you consent to our data practices.

8. Intellectual Property

MiniShoots and all related logos, designs, and content are owned by MiniShoots and protected by copyright and trademark laws. You may not copy, modify, or distribute our intellectual property without permission.

9. Service Availability

We strive to provide reliable service but do not guarantee 100% uptime. We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• MiniShoots is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We are not responsible for disputes between photographers and clients
• We are not liable for payment processing issues handled by Square

11. Indemnification

You agree to indemnify and hold harmless MiniShoots from any claims, damages, or expenses arising from your use of the service or violation of these terms.

12. Termination

We may terminate or suspend your account at any time for violations of these terms. You may cancel your account at any time. Upon termination:

• Your access to the service will be revoked
• Subscription fees are non-refundable
• You remain responsible for any outstanding fees or obligations

13. Changes to Terms

We may update these terms at any time. We will notify users of material changes via email or in-app notification. Continued use after changes constitutes acceptance of the new terms.

14. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of [Your Jurisdiction].
